One program allowed per heating season, account must be current to be eligible. Automated delivery route, receiving 250 gallons or more required. The following will void price protection resulting in remaining gallons to be priced at market rate through 4/15/05: Delivery status change to will-call, late payment on gas, merchandise or service beyond our 30 day terms. Balances beyond 30 days subject to a 1.5% monthly late fee. Late payment or non-payment will delay fuel delivery. Balances submitted to collection will incur a 33% collection fee. Eagle 1 funds are non refundable. Any credit remaining as of 4/16/05 may be applied to fuel, merchandise, service or tank rental fee. Should your fuel consumption fall below our program minimum of 750 gallons (during the timeline stated above), Motor Propane Service may charge its current posted equipment rental fee. Credits cannot be issued for unused fuel. Motor Propane Service reserves the right to correct any errors or omissions on invoices. As indicated in your lease agreement, your automated delivery is in force throughout the year. The propane distribution system cannot ensure that all tanks will receive an April delivery. Rates do not include any future imposed government tax. Force Majeure: Each party shall be excused for delay or failure in performance by reason of any cause beyond the party’s control. Specifically: war, fire, revolutions, riots, governmental acts/requests. Governmental interference or act of God, included but not limited to pipeline allocations. Nothing herein contained shall excuse the customer from paying Motor Propane Service, when due, any amounts payable. Motor Propane shall not be obligated to replace propane curtailed or cut off by reason of circumstances beyond its’ control.
